Agreement Conditions:
Renter acknowledges receipt of the equipment identified above (the “equipment”) which was examined by Renter and found to be in first-class condition upon receipt, except as noted below. Renter further acknowledges that the equipment is owned by Cactus Cart Co, the Lessor, for the use and purpose for which it was manufactured subject, however, to the terms and conditions set forth herein.
Renter will make available for pick up the equipment at the place of original drop off no later than the date and time specified above (RENTER SHALL CONTACT LESSOR BEFORE SAID TIME IF AN EXTENSION IS DESIRED) or upon Lessor’s demand therefore. The equipment shall be returned in the same condition as when received, ordinary wear accepted.
In the event the equipment is not returned on a timely basis, daily rates will apply unless other arrangements are made with the Lessor in advance. Daily rates will apply if the equipment is kept after the scheduled pick up date. All days, including weekends and holidays are chargeable.
Renter shall pay to Lessor upon demand rental for the equipment at the rate and date specified above for the period specified above.
Upon receipt of notice of any cart issue or malfunction due to no fault of the Renter, Lessor will respond within 24 hours and address any repairs to be made or needed. If repairs cannot be done on site, a replacement cart of similar style and features will be delivered at no charge to Renter.
TERMS OF AGREEMENT
1. Renter is responsible for all damages to the cart, or any property damaged by the use of the cart during the rental period and shall reimburse Lessor or property owner upon demand for the loss of, or any damage to equipment or property damage while it is rented to Renter and for all costs and labor or other expenses, including attorney’s fees incurred by Lessor in collecting any amounts owed by the Renter hereunder or in otherwise enforcing Lessor’s rights hereunder. Any security deposit can be utilized by Lessor for assessed damages.

2. Renter shall indemnify and hold Lessor harmless from and against any and all liability, including bodily injury and property damage arising out of the use or operation of the equipment by Renter or anyone using or operating the equipment with Renter’s express or implied consent; provided however, that Lessor shall be responsible for loss or damage resulting from Lessors sole negligence.
3. Renter shall abide by all rules and regulations of Lessor governing the use of the equipment.
4. Renter will not assign this Rental Contract to any other party or sublease the equipment.
5. Renter will allow Lessor to make a photocopy of the driver’s license of the person(s) renting and other authorized driver(s) of the equipment, as well as provide renters or homeowners proof of insurance coverage.
GOLF CART RULES
1. Operator(s) of the golf cart must be at least 16 years of age and have a valid unrestricted driver’s license. Cart privileges are forfeited if underage driver(s) is caught/reported driving the cart.
2. Pedestrians, pedal karts, bikes and wheeled toys always have the right of way.
3. Renter is responsible for all actions of all passengers and persons operating the cart with your express or implied permission.
4. Under no circumstances may the operator be under the influence of any intoxicating substance (i.e. drugs, alcohol, etc.). Doing so/being reported doing so will result in revocation of rental privileges and impound of cart with no refunds.
5. Golf carts operated after sunset must have their lights turned on if applicable.
6. Golf carts must be operated respectfully. Please check the speed limit where you are using the cart. Horseplay, racing or other misuse of cart will not be tolerated.
7. Golf carts are to be operated on private roads in gated communities/golf courses. Golf carts are not allowed on public roads, highways, or past the main gates. Golf carts are never to be ridden through any creek or water. Doing so will terminate golf cart agreement without refund. Damages may be separately assessed and charged.
8. Golf carts must be available for pick up at the designated time set forth above. Unavailable carts will be charged $45 per weekday and $75 per day weekend or holiday.
9. Golf carts can carry a maximum of 3 people on 2 seat carts and 5 people on 4 seat carts. Passengers must be seated at all times when the cart is in motion.
10. Renter is to report any malfunction or issue to management immediately by phone. Texting or email will not be sufficient notice of cart malfunction. No refunds or partial refunds will be awarded for any issues not reported at time of issue.
11. All rental carts have a governed speed limit and are all delivered in good working condition with delivery inspection reports filled out for every drop-off. Signing this agreement and any subsequent forms associated with the rental, as well as accepting the cart onto the rental premises and keeping the cart after the driver has left, waives all rights to any credit card chargebacks for any reason including but not limited to Non Receipt of Goods, Product Not as Described, Product Not Rendered, Product Not Delivered and all other related chargeback reasons.
12. Please do your due diligence. Cactus Cart Co. is not responsible for violations, fines, suspensions or any other adverse action due to Renter’s use of cart. No refunds will be provided for these circumstances after the rental period has begun.
13. Violating the following rules will be cause for immediate loss of cart privileges,payments and deposits, plus impound of cart–
PLUS NO REFUNDS WILL BE GIVEN for rule violations or any other circumstances not expressed in this agreement, such as but not limited to:
a. Underage drivers – NO ONE under 16 shall ever operate the golf cart b. Invalid or no driver’s license presented upon request
c. Reckless driving or driving under the influence
d. Operating the cart on public roads/highway, in creeks, water or undesignated areas e. Payment or invoice unpaid or unpaid monthly payments leading to repossession
14. Acceptance of rental cart without someone present automatically implies phone signature at exact time of drop off, however does not waive the responsibility of signing all proper documents or risk termination of contract with no refunds. Late delivery does not constitute a refund except at manager’s sole discretion.
I/We have read and understand this Rental Agreement in its entirety, including all terms, conditions, responsibilities, and liability provisions. I/We agree to comply with and be bound by all terms and conditions set forth herein. I/We further acknowledge that I/We am/are financially responsible for any loss, damage, theft, misuse, or violation of this Agreement occurring during the rental period, and authorize Cactus Cart Co. to charge the payment method on file and or/invoice for any amounts due under this Agreement. By signing below, I/We acknowledge that I/We have received a copy of this Agreement and voluntarily accept all terms and conditions contained herein.
